Travel Agreement

Before we finalize your tour, cruise, or other trip, we ask that you read and sign this form, Your signature will signify your agreement with the following terms and conditions:

You must complete this form before your departure.

PROFESSIONAL FEES – We reserve the right to charge non refundable service fees for bookings, changes, special services and cancellations in addition to what may be charged by the travel vendors.

IDENTIFICATION - Government issued photo ID is required at check-in on all flights. If traveling to a foreign country, without proper identification, a passport and necessary visas, you WILL NOT be permitted to depart.  In MOST CASES, your passport must be valid six (6) months after the return of your trip.  It is your responsibility to verify your necessary travel documents as well as inoculations and Covid testing (varies by destination, cruise line and tour company).

 

LEGAL NAMES – Your reservations must reflect each travelers accurate legal name as it appear on government issued ID.  Please verify accuracy on all travelers prior to completing your reservation with our Advisors.

 

CONFIRMATION - Please check your original confirmation at time of booking as well as your final documents completely when you receive them.  Also, please notify our agency within 24 hours if an error is detected, otherwise, reservations and documents will be considered to be accurate.  Any changes after payment is applied will result in change fees.

 

DOMESTIC/INTERNATIONAL FLIGHT CHECK IN & LUGGAGE – Recommended minimum check-in time for domestic flights is 2 hours, and for international flights, 3 hours.  Some charters require 3 hours advance check-in.  Additional fees for carry-on and/or luggage may be charged at the time of check-in.  

 

RECONFIRMATION OF FLIGHTS – Times, flights, and fares are based on current tariffs that are subject to change without notice.  We recommend downloading the airline APP and reconfirming the date and time of flights with your tour operator or airline at least 24 hours for domestic and 72 hours for international.  Failure to use any portion of your reservations may result in automatic cancellation of all continuing and return reservations. 

 

INSECTICIDE – Some countries may require an air carrier to treat an aircraft passenger cabin with insecticides.  The flight you have chosen may be subject to insecticide spraying prior to your flight or while you are on the aircraft.  Federal law requires that we refer you to this website:  http://airconsumer.dot.gov/spray.htm

 

PRICE INCREASES – Airline tickets, tours and cruises are subject to supplemental price increases by the supplier or government and may be imposed after the date of purchase.  You may be charged additional sums by our agency to offset increased fees, fuel surcharges, taxes, fluctuation in foreign exchange markets or any combination thereof.  I hereby consent to any post-purchase price increases and authorize "Agency" to charge my credit card or will be paid by cash or check for such additional amounts.

 

CHANGED PLANS – Any change by carrier, cruise, resort vacation or tour, before or during your trip will result in carrier and agency  fees.  If in the event of complete cancellation, you may be asked for a letter of cancellation and will provide one if necessary.

 

AIRLINES RESERVATIONS – You must contact our agency to notify us of changes and cancellations by travelers PRIOR to departure date.  All cancellations and/or changes are subject to airline and agency fees.  All refunds are subject to final audit by the airline.  Any post refund charges implemented by the airlines will be passed onto each traveler.

 

HOTELS – are usually confirmed on a guaranteed payment basis.  If you cancel or change plans, please notify your agent or hotel(s) within the time period specified by that hotel to avoid penalties.  Failure to meet terms for cancellation will be charged to credit card provided to guarantee reservation.  SOME hotels rates are NON-REFUNDABLE at the time of booking.  Mandatory resort fees and/or cleaning fees may apply.  Please verify with your agent.

 

CAR RENTALS - All rentals are subject to rental agency, airport, local, and state taxes and fees.  Any voluntary or involuntary change of plans may affect rental rates.  Parking fees at your hotel may apply.

 

TOUR/PACKAGE PRICES – are subject to change without notice due to currency fluctuations, tariff changes or increase in operational costs.  In addition, group tours/packages are based on a minimum number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers. 

 

DURING TRAVEL ISSUES - If problems occur during your tour, always contact the local tour representative for best resolution.  Phone numbers are found in your final documentation.  Please verify prior to your departure. 

 

PUBLIC WEBSITES – If you request that our agents make reservations on public websites, you consent to the web site's terms of use, which may contain disclaimers, limits of liability and the like.

 

DISCLAIMER OF LIABLITY – "Agency" are acting as an agents for suppliers in selling travel-related services, or in accepting reservations or bookings for service that are not directly supplied by "Agency" (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.).  “Agency” therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to your or your travel companions or group members.  Unless the term “guaranteed” is specifically stated in writing on your tickets, invoice, or reservation itinerary.  "Agency" does not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects.  "Agency" shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agency’s control.  Traveler assumes complete and full responsibility for, and hereby releases the agent and travel agency from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel.  For information related to any such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on "Find International travel Information” then click on "Country Information", and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. By embarking upon his/her travel, you and your travelers voluntarily assumes all risks involved in such travel, whether expected or unexpected.  Travelers are hereby warned of such risks, and is advised to obtain appropriate insurance coverage for potential coverage.  Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.       

 

COVID-19 - After reasonable inquiry, you have been provided with the best available information regarding the pandemic-protective policies and practices of the suppliers involved, but that you understand that the supplier(s) may not apply those policies as diligently as the policies suggest. Even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate.  Health and safety practices may vary by airline, hotel or cruise line and are subject to change at anytime.  In the event that you are denied travel upon departure or returned from your destination early, our agency carries no responsibility.  We will make our best efforts to update you with changes. 

 

WHAT YOU SHOULD KNOW ABOUT THE POSSIBLITY OF TRAVEL RELATED BANKRUPTCIES

Hopefully, there will not be any more travel related bankruptcies, but it has to be recognized that they might occur.  You should know how they might affect you. 

  1. If a travel vendor (which includes airlines, cruise lines, tour companies or anyone with whom "Agency" books travel) declares bankruptcy, it may not be required to issue refunds or honor tickets purchased before the date it declares bankruptcy.

  2. Travel agents are not allowed to refund tickets for travel vendors that have declared bankruptcy.  Money given to "Agency" immediately becomes the property of the Travel Vendor, and we are required by laws to comply with the travel vendor orders.

  3. If a travel vendor declares bankruptcy it might continue service, limit service, or stop service completely.  Other travel vendors might accept passengers or customers under limited circumstances from the defaulted Travel Vendor.

  4. By accepting the services listed in this document, you agree that "Agency" cannot be held responsible for reservations or services purchased for a travel vendor if that travel vendor declares bankruptcy.

“Agency” and its agents have endeavored to secure the lowest possible prices, suitable for your travel requirements, based on space available at the time of booking, accessible sources of information and knowledge of agents involved. 

PLEASE NOTE that retention of tickets, reservations or bookings after issuance shall constitute acceptance of all the provisions in the conditions listed hereto as well as those terms and conditions set forth in the announcements and circulars of the tour/package, cruise or service.

BILLING – purchases made by credit card may appear as separate charges on a credit card statement(s), one or more by the travel supplier and one or more by "Agency".

PAYMENT - You agree to pay all fees or charges to your account in accordance with the fees, charges and billing terms in effect at the time a fee or charge is due and payable. You also agree to pay all applicable taxes included and/or billed as you travel. You must provide "Agency" with valid payment information in connection with your planned trips. By providing "Agency" with your payment information, you agree that (i) "Agency" are authorized to immediately invoice your Account for all fees and charges due and payable to "Agency" hereunder, (ii) "Agency" are  authorized to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and other related travel services), and (iii) no additional notice or consent is required for the foregoing authorizations. You agree to immediately notify agents of "Agency" of any change in your payment information. "Agency" reserve the right at any time to change its prices and billing methods. If payment cannot be charged to your payment card or your payment is returned for any reason you agree to pay "Agency" with an alternate form of payment immediately otherwise, your reservations may be canceled.

 

INSURANCE PROTECTION – "Agency" strongly recommend purchasing cancellation insurance at the time of your booking.  All reservations are subject to up to a 15% agency cancellation fee.
